Step 1: Serving The Right Notice
Before filing an Eviction, Florida law requires Landlords to give tenants proper written notice. For unpaid rent, that means a 3-Day Notice to Pay or Vacate, not counting weekends or legal holidays. For Lease violations that do not pertain to rent, a 7-Day Notice to Cure is typically required, which gives the Tenant a week to fix the issue.
Step 2: Filing The Eviction
If the Tenant doesn’t respond to the notice, the next step is to file an Eviction in the county court where the property is located. This paperwork includes a copy of the notice you served, the lease (if there is one), and details about the violation.
Step 3: Serving The Tenant
Once the case is filed, a summons is issued. Thereafter, it must be delivered to the Tenant by a sheriff or licensed process server. The Tenant has five business days—excluding weekends and holidays—to respond in writing.
Step 4: Response Or No Response
If the Tenant responds, the court may set a hearing requiring the tenant to deposit rent into the court registry. If they don’t respond, the landlord can request a default judgment, which is a court order granting possession of the property.
Step 5: Writ Of Possession
Once a Judgment is entered, a Writ of Possession is issued. The sheriff posts this notice at the property, giving the tenant a short time (24-hours notice) to move out. If they don’t leave, the sheriff will return to remove them, and the landlord can legally change the locks.
How Long Does the Florida Eviction Process Take?
An Uncontested Eviction can take as little as 2–5 weeks. This depends on how quickly the paperwork moves and how busy the court and sheriff are. Contested cases—where the tenant fights the eviction—can take 4–8 weeks or longer.
