Florida Tenant remains in the property after lease expires
Sometimes, Florida Landlords are forced to deal with the unfortunate situation of a Tenant remaining in the property after their lease terminates. If a Tenant is still residing in the property after the lease terminates, the Landlord has the right to commence eviction proceedings against the Tenant as well as attempt to recover double the amount of rent due for the period during which the tenant refuses to surrender possession. This is governed by Florida Statute 83.58 and the Tenant will be considered a “holdover tenant.” The advantage that a Landlord has if they have a Tenant that has not vacated the property after the lease expires, is that they are entitled to summary procedure in the Florida Court system and the Court will allow the Landlord to have their case heard in a timely manner.
